Key Dates

If you are a Settlement Class Member in Records and have any other billed charge that you believe qualifies as a Qualifying Billed Charge but is not reflected in BCBS-GA’s records, or if you are a Settlement Class Member Not In Records with valid Qualifying Billed Charges, you could have submitted a Claim Form for those charges. See FAQ 6 for more information.

If you didn’t want to be part of the Settlement, or if you wanted to keep the right to sue or continue suing BCBS-GA on your own about the Released Claims, then you had to exclude yourself ("Opt Out") from the Settlement Class. See FAQ 10 for more information.

If you did not exclude yourself from the Settlement Class, then you could have objected to the Settlement if you don’t agree with any part of it. You could have provided reasons why you think the Court should deny approval of the Settlement by filing an objection. See FAQ 15 for more information.

If you wanted to speak at the Fairness Hearing, you had to timely file an objection and state in that objection that you wanted to speak at the hearing. See FAQ 19 for more information.

If you received notice by mail (or believe you meet the definition of the Settlement Class), and you did nothing and the Settlement reaches Final Approval, then you will be a Settlement Class Member. Even if you did not submit a Claim Form, you will be bound by the Settlement’s release and other terms.

The Court will hold a Fairness Hearing to decide whether to approve the Settlement. You may attend and you may ask to speak, but you are not required to. See FAQ 17 for more information.
